In San Mateo, it is illegal to drive under the influence of drugs or alcohol. According to California law, a person can be arrested for DUI or DWI if: he/she is impaired by drugs or alcohol; OR he/she is driving with a blood alcohol concentration of 0.08% or higher. If a person has a BAC of 0.08% or higher, or if they refuse to submit to chemical testing, his/her driver’s license will automatically be suspended. In some cases, the driver’s motor vehicle may also be impounded.

From the time of their arrest, people facing DUI charges have only 10 days to schedule an administrative hearing with the California Department of Motor Vehicles. By scheduling a hearing with the DMV, people charged with a DUI can contest their license suspension. If a person fails to schedule a hearing with the DMV, his/her driver’s license will automatically remain suspended.
