Second DUI

The penalties for a second DUI conviction are increasingly worse than those of first time offenders. If the second DUI occurs at any time during your probation, not only will you be sentenced for first time DUI punishments but also for violating your probation. The probation violation can carry as much if not more jail time as the second DUI itself. Two DUI’s within ten years have severe punishments: probation can be from 3 to 5 years depending on the factors; jail sentence is a minimum of 3 days and maximum of one year; license suspension for two years, fines and other court fees that can be up to $3,000; further alcohol education programs and an ignition interlock device installed into your car. The possibility of obtaining a restrictive license remains as long as the driver doesn’t refuse to take a chemical test.
